ELIGIBILITY: The Gillette Personal Best Contest (the “Contest”) is offered only to individuals who are legal residents of Canada who are 18 years of age or older at the time of entry. Employees, officers, and directors of Procter & Gamble (“Procter & Gamble” or “Sponsor”), GMR LLC., BAM Strategy Inc., their respective parents, affiliated and subsidiary companies, advertising and promotional agencies, prize suppliers, web masters and web suppliers and persons engaged in the development of Promotion materials, and members of the immediate family (parents, siblings, children and spouse, wherever they reside) or same household members (whether or not related) of such employees, officers, members, and directors are not eligible. Groups, clubs, organizations, commercial entities, and businesses cannot participate. By participating, you agree to these Official Rules and all decisions of Sponsor and/or BAM Strategy Inc, an independent judging and administration organization, which are final and binding in all respects. Void where prohibited by law.
PROMOTIONAL PERIODS/DRAWING SCHEDULE: Contest begins on January 12th, 2009 (the “Start Date”) at 10:00:01 a.m. Eastern Time (“ET”) and ends on May 31, 2009 at 11:59:01 p.m. ET. Sponsor’s computer is the official clock for the Contest. There are Three (3) prizes available to be won; One (1) Prize will be awarded in each of the following Entry Periods:
Prize Winner #1 will be selected from among eligible entries received by February 15, 2009
Prize Winner #2 will be selected from among eligible entries received by April 5, 2009
Prize Winner #3 will be selected from among eligible entries received May 31, 2009
Winner selection will be determined within Two (2) days of the end of each Entry Period outlined above and will include only those entries received before the entry deadline of 11:00 am ET except for the final Entry Period which ends at 11:59:01 pm on May 31, 2009, the contest closing date. Limit One (1) entry per participant. Non-winning entries from each Entry Period WILL be carried over into the next Entry Period.
Any attempted participation in any manner other than as expressly stated in these Official Rules is void and will NOT result in a Contest entry.
HOW TO PARTICIPATE:
Register at the Web Site. During the Promotional Period, access the Web site at www.gillettepersonalbests.ca (the “Promotional Web Site”) and click on the icon, banner, or text link to access the registration page. At that point, you must:
- Access the registration page by following the instructions on the home page.
- Complete the Official Entry Form with your first and last name, complete address, email address, date of birth, and phone number, as well as agree to these full Contest Rules and Regulations.
- In 400 characters or less, tell us what your Personal Best Goal is for 2009 and how $5,000.00 CDN will help you achieve your Goal.
- After entering all requested information, click the “Submit” button to submit your entry.
- You must be 18 years of age or older at time of entry to be eligible. Include the name and e-mail address of your parent/legal guardian next to yours on the Entry Form fields (preferably in brackets) if you are a minor in your province/territory of residence
By registering and submitting a Personal Best Goal Entry, you agree that your Entry adheres to the Content Restrictions as defined below and that the Sponsor, in its sole discretion, may disqualify your Entry if Sponsor believes, in its sole discretion that your Entry fails to comply with the Content Restrictions in any way.
Content Restrictions :
- The Entry must not contain material that:
- Violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
- Includes brand names or logos or trademarks;
- Contains or describes indecent behavior, profanities or obscenities, including but not limited to nudity, or pornography;
- Disparages persons or organizations associated with Sponsor;
- Includes text or photos not created by entrant;
- Is hateful, tortuous, defamatory, slanderous or libelous;
- Includes threats to any person, place, business, or group;
- Contains defamatory statements (including words or symbols that are widely considered
offensive to individuals of a certain race, ethnicity, religion, sexual orientation, or socioeconomic group) or promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
- Invades the privacy or other rights of any person, firm, entity; and
- Is unlawful, in violation of or contrary to all applicable federal, provincial, or local laws and
regulations.
- The Photo submitted with your Entry must be a photo of yourself, for which you have sole ownership, and must not include any other person, brand name, or recognizable logo or trademark.
For all Entries: Failure of any Entry to comply with the above Content Restrictions, as determined by Sponsor and/or Administrator in their sole discretion, may result in disqualification. All Entries will become the exclusive property of Sponsor, and none will be acknowledged or returned. Sponsor shall have the right to reproduce, copy, broadcast, edit, adapt and publish any or all of the Entries, and may use them in any media whatsoever throughout the world, without limitation, for any and all advertising, promotions, and other purposes of trade, without attribution or compensation to the entrant, his/her successors or assigns, or any other entity. SUBMITTING AN ENTRY IN THIS CONTEST CONSTITUTES YOUR IRREVOCABLE ASSIGNMENT, CONVEYANCE AND TRANFERENCE TO SPONSOR ANY AND ALL RIGHT, TITLE AND INTEREST, AND ALL RESIDUAL INTERESTS IN THE ENTRY INCLUDING, WITHOUT LIMITATION, ALL COPYRIGHTS AND ANY RENEWALS AND EXTENSIONS THEREOF. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected Entry, which are void and will be disqualified. Sponsor, in its sole discretion, may feature any Entry submitted in this Contest at any time during, or after, the Promotion Period on any related websites, in any promotional materials, whether related or unrelated to the Contest, and at any other location, whether physical or online, that Sponsor, in its sole discretion, deems appropriate and necessary for the operation and promotion of this Contest.
PRIZES/APPROXIMATE RETAIL VALUES/ODDS: There are Three (3) Prizes available to be won, each consisting of a cheque in the amount of $5,000 CDN plus travel and accommodation to meet and consult with a Panel of Experts who will help you achieve the Personal Best Goal described in your entry. Method of travel, location, timing of trip and selection of Panel of Experts to be determined by Sponsor, in its sole discretion. Trip must be taken before August 31st, 2009. All other expenses not specifically described herein, including without limitation applicable taxes, fuel/currency surcharges, additional transportation, room service, gratuities, merchandise, telephone calls, insurance, together with any travel documentation and all personal expenses of any kind or nature are the sole responsibility of the winner. It is the sole responsibility of the winner to obtain all necessary travel documentation, including passports and visas, if applicable and to comply with any customs and immigration requirements. Total Approximate Retail Value $6,900 Cdn each (depending on point of departure).
SELECTION CRITERIA:
Winners will be selected by a judging panel composed of representatives from Sponsor and GMR Marketing LLC, whose decisions are final, from among all eligible entries received within the posted Entry Period. Eligible entries will be judged based on the following criteria:
How achieving your Personal Best Goal will help you look, feel and be your best
How your Personal Best Goal could inspire others to achieve their best
How you think $5,000 and expert advice could help you achieve your Personal Best Goal
Winners will be selected within 2 days of the end of each Entry Period outlined above. Chances of being selected as a winner will be based on the judges’ decision and upon the number of eligible entries received within each Entry Period including non-winning entries that are rolled over from one Entry Period to the next.
Potential winners will be notified on or about February 20, April 10, June 5 2009, by email, phone or express mail to the phone number or address listed on the Official Entry Form. If a potential winner is deemed unreachable, or a prize notification returned as undeliverable, the prize will be forfeited in its entirety and an alternate winner will be selected from among all remaining eligible entries. To be declared a Winner, the selected entrant must complete a Declaration of Eligibility, a Publicity Release, and a Release of Liability, and return the Documents within seven (7) days of receipt, or prize may be forfeited and an alternate winner chosen from among all remaining eligible entries. Proof or verification of identity and eligibility may be required. Failure to comply may result in disqualification and selection of another potential winner.
Publicity Release: Acceptance of prize by winner constitutes winner consent that their name, likeness, voice, biographical data, photo and/or video, personal goal essay & 3 updates on progress against winner’s goal may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent, including a winners’ list.
CONDITIONS FOR PRIZES: It is the responsibility of each participant to maintain his/her registration and contact information current; and Sponsor will have no responsibility or liability for a participant’s failure to do so. Winners are solely responsible for all costs and expenses not specified in these Official Rules. Only one prize will be awarded per contest winner, household, family, group or organization. Prizes must be accepted as awarded and may not be transferred, assigned, redeemed for cash or substituted, except in Sponsor’s sole discretion who may substitute any prize or prize component with a prize or prize component of equal or greater value for any reason, due to circumstances beyond their control. No more than the stated number of prizes will be awarded.
GENERAL CONDITIONS: Participants agree (a) that Sponsor, GMR LLC, BAM Strategy, and their respective parents, subsidiaries and affiliated companies, advertising and promotion agencies, and each of their respective officers, directors, employees, members, representatives and agents will have no liability whatsoever for, and shall be indemnified and held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s), including death, or property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of any prize, or participation in this Contest or Contest-related activities and (b) acknowledge that said parties have neither made nor are in any manner responsible for any warranty, representation or guarantee, express or implied, in law or in fact, relative to any prize, including but not limited to, its quality, merchantability or fitness for the intended purpose; and (c) winners of prizes grant (and agree to confirm such grant in writing promptly upon request) to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, photograph, likeness, voice, image, statements, and biographical information for advertising, trade, publicity, and promotional purposes in any media now known or hereafter discovered, worldwide, including the World Wide Web without review, notification or approval, or further compensation, including a winners’ list. Winners of prizes may be required to complete, sign, and return a declaration of eligibility, a liability release and a publicity release within an indicated time after receipt of notification. If such documents are not returned on a timely basis, or if any notification or prize is returned as non-deliverable, or if a winner of any prize is found to be ineligible or not in compliance with these Official Rules, such prize will be forfeited.
LIMITATIONS OF LIABILITY: Neither Sponsor, GMR LLC or BAM Strategy are responsible for lost, late, incomplete, stolen, misdirected, or illegible requests, plays, registrations or email; or for any computer, telephone, satellite, cable, network, electronic, or Internet hardware or software malfunctions, failures, connections, or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/Web site/use net accessibility, availability, or traffic congestion, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture or provision (as appropriate) of registration, voting, or other information, or the failure to capture, or loss of, any such information. Neither Sponsor, nor BAM Strategy are responsible for any incorrect or inaccurate information, whether caused by Web site users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the Web site. The right is reserved by Sponsor, at Sponsor’s sole discretion, to disqualify any individual found, at Sponsor’s sole discretion, to be tampering with the registration process or the operation of the Contest or Web site, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Any use of robotic, automatic, macro, programmed, or like methods will void all registrations and/or plays effected by such methods, and any participant using such methods will be disqualified. Neither Sponsor, nor BAM Strategy are responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials from the Web site or use of the Web site. If, for any reason, the Contest is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion, deems could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Promotion and proceed with the Contest and the award of prizes in a manner deemed by Sponsor in its sole discretion, to be fair, appropriate, and consistent with these Official Rules. Notice of such action by Sponsor will be posted on www.gillettepersonalbest.ca. In case of dispute, Official Entries submitted will be declared entered/submitted (as appropriate) by the authorized account holder under whose email address and password the entry was submitted (as appropriate). Sponsor and its agencies are not responsible for any typographical or other error in the printing of the offer, administration of the Contest, or in the announcement of the prizes.
IN NO EVENT WILL SPONSOR, GMR LLC, BAM STRATEGY OR THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, REPRESENTATIVES AND AGENTS BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
This contest is subject to all applicable federal, provincial, municipal and local laws and regulations.
